- Forbaby guarantees its customers the opportunity to return any goods within 14 days of receipt of the goods.
- The right of withdrawal from a contract concluded remotely does not apply to the consumer in the cases listed in paragraph 14
- The only condition for returning the goods is to send a statement of withdrawal to the seller's address within 14 days from the day you took possession of the goods or a third party other than the carrier.
- The option to return the goods within 30 days does not apply to the customer's refusal to accept the ordered goods at the time of delivery by the courier. In such a situation, the general legal provisions on returns contained in the Consumer Rights Act and the regulations of the Civil Code on the performance of obligations under reciprocal contracts apply. .
- In case of unjustified refusal to take the goods delivered to the customer in accordance with the contract, the buyer is obliged to reimburse all costs incurred by the seller for the handling of the order. By the above is meant the cost of: packing the goods, IT handling of the order, delivery of the goods to the customer and return of the goods to the seller.
- The consumer is obliged to return the item to the trader or give it to a person authorized by the trader to collect it immediately, but no later than 14 days from the day on which he withdrew from the contract.
- The consumer shall be liable for any diminution in the value of the item resulting from use beyond what is necessary to ascertain the nature, characteristics and functioning of the item.
- Any returned goods must be packed in a cardboard box. Please provide the product, if possible, with the fiscal receipt received when purchasing the goods, or provide the vat invoice number. Printed and completed RETURN FORM should be packed in the parcel.
- We return the money immediately, no later than 14 days from the withdrawal of the customer from the contract, by bank transfer or, if no account is provided, by postal order. The bank account number necessary to return the money to our customers can be provided by e-mail or registered mail to the company's address
- The cost of returning the goods by the customer is not financed by the seller, which means that the consumer bears the direct cost of returning the item.
- Lighter goods (up to 5 kg) are best sent to us by mail using economy parcel.
- There is an option to return by courier from DHL. The cost of delivery of goods returned in this way will be 50 PLN per parcel up to 30 kg - initially paid by Forbaby This will later be deducted from the amount returned to the customer after we receive the goods (does not apply to bulky parcels, pallets and foreign shipments).
- All returns of goods should be sent to: Ibebe Forbaby, 6 T.Rejtana St., 42-200 Czestochowa.
- In the case of returning goods purchased on installments, the consumer can withdraw from the loan within 14 days from the date of the agreement. It is enough to send a form to the bank.
- The right of withdrawal from a contract concluded at a distance does not apply to the consumer in cases:
- the provision of services, if the entrepreneur has performed the service in full with the express consent of the consumer, who was informed before the start of the service that after the performance by the entrepreneur will lose the right to withdraw from the contract;
- the provision of a service in which the price or remuneration depends on fluctuations in the financial market, over which the trader has no control, and which may occur before the end of the deadline for withdrawal;
- in which the subject of the performance is a non-refabricated item, produced to the consumer's specifications or serving to meet his individualized needs;
- in which the subject of the performance is an item that is perishable or has a short shelf life;
- in which the subject of performance is an item delivered in a sealed package that cannot be returned after opening the package for health or hygiene reasons, if the package has been opened after delivery;
- in which the subject of the performance are things that after delivery, due to their nature, become inseparably connected with other things;
- in which the subject of performance is alcoholic beverages, the price of which was agreed upon at the conclusion of the sales contract, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the entrepreneur has no control;
- in which the consumer expressly requested that the trader come to him to perform urgent repair or maintenance; if the trader provides in addition other services than those which the consumer requested, or provides things other than spare parts necessary for the repair or maintenance, the consumer has the right to withdraw from the contract with respect to additional services or things;
- in which the subject of performance is sound or visual recordings or computer programs delivered in sealed packaging, if the packaging has been opened after delivery;
- delivery of newspapers, periodicals or magazines, except for a subscription contract;
- concluded through a public auction;
- provision of accommodation services, other than for residential purposes, transportation of goods, car rental,
- catering, services related to leisure, entertainment, sports or cultural events,
- in which the contract specifies the day or period of service provision;
- the supply of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the consumer before the expiration of the withdrawal period and after the trader has informed him of the loss of the right of withdrawal.
- Final provisions
- Issues not covered by these terms and conditions are governed by the Consumer Rights Act of May 30, 2014, item 827 and the Civil Code.
- In the event that any doubts of interpretation or ambiguity arise, the provisions of the legal acts referred to in the preceding sentence shall prevail and apply. In such a situation, the customer always has the right to choose the option that is more favorable to him.
