We would like to inform you that providing personal data contained in the form is voluntary, but necessary for the execution of the order, and that you have rights to access your personal data, to change them (including updating), as well as other rights described in the Privacy Policy (link). The personal data you provide will be processed by us in accordance with the law, for the purpose of processing the order, and if you have provided certain consents - also on the basis of the aforementioned consent and for the purpose specified in its content. In addition, we will process your data on the basis of our legitimate interest as a data controller, for the purposes described in the Privacy Policy, including to perform research and analysis and for marketing purposes (direct marketing of our own products). This privacy policy is designed to help you understand what data we collect and for what purpose, and what we use it for.

Personal data (RODO)

(1) In accordance with Article 13 (1) and (2) of the General Data Protection Regulation of April 27, 2016. (RODO) we inform you that the Administrator of the personal data left is Mr. Arkadiusz Łęgowik “Forbaby”, 10 Prusa Street, 42-242 Rędziny, Poland, NIP: 9491864972, e-mail address: kontakt@bexa.eu, hereinafter referred to as: (“Store”). The Data Protection Supervisor is Mr. Arkadiusz Łęgowik, who can be contacted via the above e-mail address.

(2) If you have questions about the manner and scope of processing of your personal data by the Store, as well as your rights, you can contact the Store via kontakt@bexa.eu.

In a situation where the processing of personal data is based on the consent of the data subject, the provision of your personal data is voluntary.

(4) The provision of your personal data is mandatory, in a situation where the premise for the processing of personal data is a provision of law or a contract concluded between the parties.

5. your personal data will be processed:

a. pursuant to Article 6(1)(a) - (f) RODO in order to conclude a contract with you for the sale of Goods offered by the Store and to perform the contract concluded with you.

b. for the purpose of answering your question provided in the contact form or responding to your complaint, as well as fulfilling the Store's legal obligations, detecting and preventing abuse, establishing and defending and pursuing claims, direct marketing, creating statements, analyses and statistics, verifying payment reliability, handling complaints and requests, technical support, financial settlements, including the issuance of accounting documents,

c. on the basis of a legal provision, i.e. Article 6(1)(b) and (c) RODO, without the need for your consent to the processing of personal data - to the extent necessary for the performance of the contract concluded with you, as well as to the extent necessary for the Store to take action at your request and to the extent necessary for the fulfillment of a legal obligation incumbent on the Store,

d. on the basis of Article 6(1)(a) of the RODO - in situations where you express additional consents - in order to provide information on goods, services and other marketing activities (so duly expressed: consent to profiling, i.e. automated decision-making performed on the basis of personal data, consent to the promotion and marketing of products or services offered by Partners, consent to the transmission of commercial information by electronic means, consent to the use of telephone terminal equipment and automatic calling systems for direct marketing purposes).

Your personal data will be stored for the period necessary to fulfill the purposes specified above, until the statute of limitations for claims under the contract/provision of services or until the expiration of the obligation to store data under the law, in particular the obligation to store accounting documents relating to the contract.

(7) In connection with the processing of your personal data, you have the following rights:

a. the right to access your personal data, including the right to obtain a copy of such data;

b. the right to request rectification (amendment) of personal data - in case the data is incorrect or incomplete;

c. the right to request erasure of personal data (the so-called right to be forgotten), in case:

 i.   the data are no longer necessary for the purposes for which they were collected or otherwise processed,

 ii. the data subject has objected to the processing of personal data,

 iii. the data subject has withdrawn consent to the processing of personal data, which is the basis for the processing and there is no other legal basis for the processing,

 iv.   personal data is processed unlawfully,

 v. the personal data must be deleted in order to comply with a legal obligation;

d. the right to request restriction of the processing of personal data - in case:

 i. the data subject questions the accuracy of the personal data,

 ii. the processing of the data is unlawful and the data subject objects to the erasure of the data, requesting instead that the data be restricted,

 iii.   The controller no longer needs the data for its purposes, but the data subject needs the data for the establishment, defense or assertion of claims,

 iv.   the data subject has objected to the processing of the data, until it is determined whether the legitimate grounds on the part of the Controller override the grounds for the objection;

e. the right to data portability - in case the following prerequisites are met together:

 i. the processing of data takes place on the basis of a contract concluded with the data subject or on the basis of consent expressed by the data subject,

 ii. the processing is carried out by automated means;

f. the right to object to data processing - where the following prerequisites are met together:

 i. there are reasons related to your particular situation, in the case of processing based on a task carried out in the public interest or in the exercise of public authority by the Administrator,

ii. the processing is necessary for purposes arising from legitimate interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

(8) Where the processing of personal data is based on your consent to the processing of personal data (Article 6(1)(a) of the DPA), you have the right to revoke that consent at any time. Such revocation shall not affect the compliance of the processing carried out on the basis of the consent before its revocation with the applicable law.

(9) In connection with the processing of data for the purposes referred to in Section 6, your personal data may be transferred to entities that help us operate the website, including communication with our customers (e.g., support us in sending e-mails and, in the case of advertising activities, also in marketing campaigns), provide support and operation of our ICT tools and systems (e.g., data storage), as well as to companies that process shipments, entities that process payments on our website and provide ongoing legal services, conduct audits, etc.

Your personal data may exceptionally be transferred to our processing partners outside the European Economic Area (EEA), but only to the extent necessary, related to the provision of services by these partners to us, especially IT services (e.g., cloud storage) and supporting the functionality of the online store and websites. All of our Partners required to apply standards in accordance with the requirements of the RODO. Our infrastructure is secured in accordance with best practices and the website and web forms have SSL certificates.

11. if you become aware of unlawful processing of your personal data, you have the right to lodge a complaint with the supervisory authority responsible for data protection.

Cookies

Cookies commonly known as “cookies” are small files stored on a visitor's device by websites that are visited by the visitor. a.    session files - temporary files stored on the user's end device until the user logs out, leaves the website and applications or shuts down the software (web browser);

b. permanent - stored on the user's end device for the time specified in the parameters of cookies or until they are deleted by the user.

4 The store uses external cookies to collect general and anonymous statistical data via Google Analytics analytical tools (administrator of external cookies: Google Inc. based in the USA).

Occasionally, the Store may use third-party publishers to serve ads and optimize marketing communications. Information collected by publishers may include data such as geolocation data (based on IP address) or contact information such as email address.
